Terms and conditions

This English translation is provided for convenience only. In the event of any discrepancy, the German version shall prevail.

1. Scope and contracting party

These general terms and conditions apply to orders placed in the Carts Online shop of S.I.C – Entwicklungs- und Vertriebs GmbH, Am Eisberg 8, 72202 Nagold, Germany, represented by the managing director, Dipl.-Ing. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or self-employed profession.

2. Order and conclusion of contract

The presentation of the products does not constitute a legally binding offer but an invitation to place an order. You can add goods to the shopping cart without obligation, change quantities and remove items. Before submitting your order, you can check and correct your details in the ordering process. By clicking the final order button, which clearly indicates the obligation to pay, you submit a binding offer to purchase.

You will receive an automatic acknowledgement of receipt by e-mail. This initially only confirms that your order has been received. The contract is concluded when we accept your order by sending an express order confirmation or by shipping the goods. If we ask you to pay beforehand, or if payment is collected at our instigation, the contract is concluded at that point.

3. Language of the contract and contract text

The language of the contract is German. You can save or print the order data and these terms before completing your order. You will receive the order confirmation by e-mail. Please keep the documents relating to your order.

4. Prices and payment

All prices shown in the shop are in euros and include the statutory VAT shown in each case. Any additional shipping costs are shown on the Shipping & delivery page and before you complete your order.

The payment methods available for your order are shown in the checkout. The payment terms stated there before you submit your order apply. For payment in advance, the goods are shipped once payment has been received. The bank details and payment reference will be provided to you as part of your order. For payments via external payment service providers, their terms provided during the payment process also apply.

5. Delivery

We deliver to the delivery addresses offered in the ordering process. Delivery times are shown on the respective product page. If payment in advance has been agreed, the delivery period begins once the agreed payment has been received. If an order contains items with different delivery times and joint delivery has been agreed, the delivery time is determined by the item with the longest delivery time.

We will inform you about goods that are not available or about obstacles to delivery. Your statutory rights remain unaffected. You will not incur any additional costs for partial deliveries arranged by us.

6. Right of withdrawal

Consumers have a right of withdrawal if the statutory requirements are met. Details and the model withdrawal form can be found under Right of withdrawal and Withdrawal form. Statutory exclusions, in particular for goods made to individual specifications, are governed by the conditions stated there. These terms do not grant entrepreneurs any additional contractual right of withdrawal.

7. Retention of title

The goods remain our property until paid for in full.

8. Rights in the event of defects and transport damage

The statutory rights in the event of defects apply. Information on any additional guarantees and their conditions can be found with the respective product, where applicable. A guarantee does not restrict statutory rights.

Please notify us of any visible transport damage as soon as possible. Failure to do so does not restrict the statutory rights of consumers.

9. Liability

The statutory provisions on liability apply.

10. Data protection

Information on the processing of personal data and your rights can be found in our privacy policy.

11. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence.

12. Consumer dispute resolution

We are not willing to participate in dispute resolution proceedings before a consumer arbitration board. Any statutory obligations remain unaffected.
